Why the suit against the individual mandate

Colorado Attorney General John Suthers explains why he has joined with other state attorneys general in a federal suit challenging the constitutionality of the health care law’s mandate on all individuals in the U.S. to purchase health insurance if they do not receive it through an employer. The suit, he says, is not based on a political view of the the goodness or badness of Obamacare, but solely on the fact that the individual mandate grants Congress a power over individuals that has never before been claimed and that is nowhere provided in the Constitution.
